CONWAY, SC (WMBF) – A judge has disqualified the Horry County Solicitor's Office handling the prosecution of Javon Gibbs, one of two men charged with kidnapping and murdering Aynor teen Zachary Malinowski, due to a conflict of interests.
Chris Helms, who currently works in the 15th Circuit Court Solicitor's Office, previously worked for the public defender's office more than a year ago, according to Scott Hixson with the Horry County Solicitor's Office. Because of this, the judge disqualified the 15th Circuit Court Solicitor's Office from handling prosecution in Gibbs' case.
The case will now be sent to the Attorney General, and will be assigned to another solicitor in the state, Hixson said. This will not change the venue of the case, only who is handling it.
Gibbs and Christopher Brown were charged with murder and kidnapping in the Malinowski case following the Aynor teenager's 2013 disappearance.
