Man sentenced to death in SC loses federal appeal

RICHMOND, Va. (AP) - A man sentenced to death for killing two women in South Carolina and West Virginia has lost a federal appeal.

A three-judge panel of the 4th U.S. Circuit Court of Appeals on Monday unanimously upheld a South Carolina federal judge's refusal to vacate Brandon Basham's conviction and sentence.

Basham and Chadrick Fulks were convicted of killing Marshall University student Samantha Burns and Alice Donovan of Galivants Ferry, South Carolina, after escaping from a jail in Hopkins County, Kentucky, in 2002.

Basham claimed his lawyers made several mistakes during his 2004 trial that amounted to ineffective assistance of counsel in violation of the U.S. Constitution. The appeals court found no merit in any of his claims.
