HORRY COUNTY, SC (WMBF) - A motion has been filed to reduce bond for the man charged with the murder of missing woman Heather Elvis.

According to the motion filed by Kirk Truslow, attorney for Sidney Moorer, “the defense would show that a reconsideration of the bond decision is warranted at the present time. Defense counsel has had the opportunity to review the discovery provided.”

The motion was filed December 30 and states, “the discovery provided not only contradicts the State's representations at the initial bond hearing, but further establishes that Sidney Moorer could not be legally convicted of the crimes charged.”

Moorer was arrested February 21, 2014.

In March, Sidney Moorer and wife, Tammy, were indicted by the Grand Jury in Horry County for the murder of Elvis.

Sidney was denied bond on May 17 and has been incarcerated without bond for nearly 10 months, the defense argues.

In December, a trial date of May 11 was scheduled for the murder case.
