CLEVELAND, OH (WOIO) -

Surveillance video shows why accident investigators found a drunk driver should not have been on the roads.

You see the car out of control, and seconds later the car crashes into a building, killing the passenger.

James Cook, 34, has been charged with vehicular manslaughter, OVI, and other charges. The accident happened back in April, on Broadway Avenue in Cleveland. Cook crashed into a Family Dollar store, killing one and seriously injuring another.

Cook has no history of drunk driving, but he does have convictions for no license.

He is due back in court next week, his last hearing before going on trial. He's pleading not guilty, but the video makes a statement in itself.
