Stepfather of missing teen wants 'Zack's Law'

MYRTLE BEACH, SC (WMBF) -  It's been a stressful six months for the stepfather of missing Horry County teen Zack Malinowski, but now Lonnie Jordan has an idea for a bill that will give his missing stepson a voice again.

"We don't have representation for our missing person," Jordan said. "They're not having their best interests looked at."

Jordan has created a Change.org petition for what he's calling "Zack's Law." Jordan says the law is designed to protect the civil rights of missing persons, who still have unfinished business, bills, and private accounts. The law would create power of attorney.

Jordan says it also bypasses the need for a warrant to access digital information through social media and email, which could in turn help investigators.

"We had a lot of frustration trying to get things done," he said. "One big thing we kept running into was the privacy issue."

Some authorities though, are wary of the proposed law because in order for a family member to gain power of attorney, they'd have to be ruled out as a person of interest in the investigation. A post on Jordan's website promoting Zack's Law says in the investigation, "…the family will be ruled out as probable cause right away."

"By that rule it's saying ‘You can't start here,'" says Solicitor Jimmy Richardson, "or ‘If you do start here, you can't stay here.'"
