Defunct gym responds to owed money claims

MYRTLE BEACH, SC (WMBF) – A local gym closed up shop from one day to the next, and now members say the gym's owner owes them money. One of those members contacted WMBF News but chose to remain anonymous.

The "Ladies Choice Fitness Center" in Myrtle Beach closed its doors two months ago. Owner Skip Duke says he does plan to refund prepaid members, but says it's been a longer process than he anticipated. Before the checks start going out, Duke says has to do his due diligence.

"They were offered memberships at other clubs," Duke says. "We don't know how many have taken it and if they were pre-paid with a credit card, we don't know if they charged back against a card."

Duke sent out an email at the end of December last year to all of the gym's members. It explains his decision to close Ladies Choice because the gym wasn't making enough money and he could no longer afford to keep doing business. Members were given the option to take their contracts to other local gyms. Duke explained there's been a misunderstanding with one of the gym options, but says former members can take their contracts to American Fitness and the other Ladies Choice Fitness Center location in Murrells Inlet owned an operated by a different owner.

Kathy Graham, President and CEO of the local Better Business Bureau Office (BBB) could not comment on Ladies Choice specifically. However, Graham points out most health clubs are part of a network. If a health club does shut down, members can transfer memberships to another in-network gym, and no money will be refunded. Graham says this is usually written into a gym's contract, which is why she recommends people signing up for a gym should read the contract thoroughly before signing on the dotted line.

As for the couple of dozen women who are owed money because of their pre-paid membership with the now-closed Ladies Choice Fitness Center, Duke says he is in the process of making that happen. Duke added anyone who has question should contact him.

"Email me and we will tend to it," said Duke.
