Lawsuit against Solid Waste Authority dismissed

HORRY COUNTY, SC (WMBF) - A lawsuit waged by private garbage haulers against the Solid Waste Authority in Horry County has been dismissed.

Thai lawsuit concerning a flow control ordinance also included the county itself, but a ruling in the US District Court sided with Horry County and the SWA, dismissing the case.

The garbage hauling service from Marion County, Sandlands C&D and Express Disposal Services filed the suit in respond to a law passed in 2009, requiring trash collected in Horry County to only be dumped in the SWA landfill or another facility or their choosing.

Upholding the flow control ordinance means the Solid Waste Authority can continue to collect fees from haulers depositing trash in the county landfill, and those fees are used for recycling programs.
