Family sues funeral home for not embalming loved one

HUNTSVILLE, AL (WAFF) -

A Huntsville funeral home is being sued after a family said they didn't embalm their loved one in time for the funeral.

The victim's family members are holding up pretty well, all things considered.

Family members said they miss their loved one and they are still reeling from the loss.

They said Norman Holman Jr. was 55 years old when he passed away on May 28 from a brain aneurysm.

Holman's funeral was held 12 days later on June 9.

John Brinkley Jr., the family attorney, said the family waited so long to have the funeral because they had to get everyone together after the holiday.

When that funeral was held, Brinkley said that Nelms Funeral Home did not embalm Holman, although the family said they wanted it.

They are suing for breach of contract, negligence, and emotional distress.

Brinkley said Holman still had dirt under his nails, his hair wasn't done, and that those who stopped by to show their final respects were dry heaving.

Brinkley said this isn't the first time his firm has had to file a lawsuit against Nelms Funeral Home.

Brinkley said the case should go to court sometime next year.

Nelms Funeral Home had no comment about the lawsuit.
