Officials drop rape charges against 3 men

MYRTLE BEACH, SC (WMBF) - Charges have been dropped against three men accused of kidnapping and raping a 23-year-old Myrtle Beach woman inside of a van at Broadway at the Beach.

A spokeswoman for the Horry County Solicitor's Office confirmed charges were dropped against Robert Toma Jr., 39, of Tampa, FL; Troy Terell Wilson, 31, of Allentown, PA; and Dallas Bubba Frutchey, 19, of Easton, PA on Wednesday.

Officials said the three suspects were formerly charged with first degree criminal sexual conduct and kidnapping.

According to a police report, officers were called to Señor Frogs, 1304 Celebrity Circle, around 3:30 a.m. early Wednesday morning. The victim told investigators that she had been raped by four men at Broadway at the Beach.

According to the report, the woman said she had been drinking with her sister at another establishment before going to Señor Frogs. The woman, who said she was intoxicated at the time, met Toma at the nightclub and danced with him. After some time, the victim said Toma asked her to leave with him, but she said she was waiting for her sister.

The victim reported Toma grabbed her by the arm and escorted her to a van in the parking lot and forced her inside. She said Wilson and Frutchey were already inside at the time. After stripping her, she said all three men sexually assaulted her.

Following the assault, the victim said all three men left the van, but before she was able to finish dressing herself, she said Toma returned and sexually assaulted her a second time before a fourth man entered the van and raped her.

The woman told investigators none of the suspects appeared armed at the time of the assault.

North Myrtle Beach Public Safety officers located the suspect vehicle and apprehended the suspects. The victim positively identified Toma, Wilson and Frutchey as her assailants, but was unsure of the identity of the fourth person, according to the report.

Officials with the Horry County Solicitor's Office said the charges against the men will be dismissed after the appropriate paperwork is finalized.
