Nichols, SC - MARION COUNTY, SC (WMBF) - Charges won't be filed against a homeowner who opened fire on a burglar inside of his home on Friday afternoon, according to the Marion County Sheriff's Office.
Marion County Sheriff Mark Richardson said deputies responded to a home on Pee Dee Island Road near Nichols following reports of a burglary.
Upon arrival, the homeowner told police he returned home to find an unidentified car parked under his carport. When the homeowner walked to his door, he noticed it had been forced open.
After spotting the burglar exiting a room with a number of belongings, the homeowner fired one shot and struck the suspect's hand and leg.
John Wesley Collins, 32, of Nichols, was arrested on scene and has been charged with two counts of burglary and assault with intent to kill. Records revealed Collins is currently on probation for a previous burglary in 2009.
Collins is being treated at a local hospital for non-life threatening injuries. Following treatment, Richardson said the 32-year-old will be transported to the Marion County Jail.
