CF Chronicle: Crash victim's family sues school district

Myrtle Beach, SC - MYRTLE BEACH, SC - Parents of a Myrtle Beach teen killed after his motorcycle crashed into a school bus have filed suit against Horry County Schools, according to recently filed court papers.

Rodney and Cathleen Chaplin, parents of Marc Chaplin, filed suit in Horry County Circuit Court at 3:14 p.m. March 26, claiming violations of the S.C. Freedom of Information Act (FOIA).

Chaplin attorney David Canty was unavailable for comment as of this web posting.

According to the suit, the family's attorney filed a FOIA request seeking unspecified public records from the school district on Nov. 24, 2009. The school district refused "to produce a single page of the public records request" in a letter dated Dec. 17, 2009, the suit says.

The attorney then filed a second request on Jan. 19, 2010, which the suit says went unanswered.
State law requires a written response within 15 business days. If a FOIA request isn't responded to within 15 days, it is deemed granted, the law says.
